1. Acceptance of Terms

By accessing or using Aetheris.ai ("Service", "Platform", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Aetheris.ai is an AI-powered content creation studio that enables users to generate images, videos, voiceovers, and marketing content using artificial intelligence models. The Service operates on a token-based credit system.

3. Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years of age to use the Service.
• One account per person. Multiple accounts may be terminated.

4. Token-Based Credits

4.1 Token Purchases

• Tokens are virtual credits used to access AI generation features.
• Token packages are one-time purchases processed via Stripe.
• Prices are displayed in the currency you select (USD, EUR, MXN, GBP, BRL, COP, CAD, AUD, JPY).
• Tokens are non-refundable once credited to your account, except as required by applicable law.

4.2 Free Tier

• New verified users receive 200 free welcome tokens.
• Users get 1 free AI Persona creation and 1 free Content Studio run.
• Free tier benefits are non-transferable.

4.3 Token Expiry

Tokens do not expire. However, we reserve the right to modify token costs for specific features with 30 days' notice.

5. Acceptable Use

You agree not to use the Service to:

• Generate illegal, harmful, threatening, abusive, defamatory, or obscene content.
• Create deepfakes or content that impersonates real persons without consent.
• Generate content that exploits minors in any way.
• Violate intellectual property rights of third parties.
• Attempt to reverse-engineer, hack, or disrupt the Service.
• Use automated tools (bots, scrapers) to access the Service.
• Resell access to the Service without authorization.

6. Intellectual Property

6.1 Your Content

You retain ownership of the prompts you provide. Subject to the terms of the underlying AI model providers, you are granted a license to use generated content for personal and commercial purposes.

6.2 Our Platform

The Aetheris.ai platform, including its design, code, trademarks, and branding, is owned by us and protected by intellectual property laws.

7. Third-Party Services

The Service integrates with third-party AI providers (including POE API, Cartesia, DeepSeek, and others). Your use of generated content is also subject to the terms of those providers. We are not responsible for third-party service availability or changes.

8. Limitation of Liability

The Service is provided "as-is" without warranties. To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages.
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
• AI-generated content may contain errors; you are responsible for reviewing content before use.

9. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the Settings page. Upon termination, unused tokens are forfeited.

10. Privacy

Your use of the Service is also governed by our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where the platform operator is located. Any disputes shall be resolved through binding arbitration.
